By accessing and using GamsatGenie ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

GamsatGenie is an online platform providing GAMSAT exam preparation materials, including but not limited to:

• Practice questions for all three GAMSAT sections
• Adaptive learning recommendations
• Essay feedback and analysis
• Weekly practice sessions
• Progress tracking and analytics

3. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate, current, and complete
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription Terms

4.1 Free Tier

We offer a free tier with limited access to practice questions. Free tier users are limited to 10 questions per day.

4.2 Premium Subscriptions

Premium subscriptions provide unlimited access to all features. Subscriptions are available on a monthly or annual basis. By subscribing, you agree to pay the subscription fees as displayed at the time of purchase.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

4.4 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will notify you of any price changes in advance.

5. Payment and Billing

Payments are processed through Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method. You agree to pay all charges incurred in connection with your account.

All fees are in Australian Dollars (AUD) unless otherwise stated. Prices are exclusive of any applicable taxes, which will be added to your total as required by law.

6. Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. If you are not satisfied with the Service within 7 days of your initial subscription, you may request a full refund by contacting us at the email address provided below.

Refunds will not be provided for:

• Subscriptions cancelled after the 7-day period
• Renewal payments
• Accounts that have been suspended or terminated for violation of these Terms

7. User Content and Intellectual Property

7.1 Your Content

You retain ownership of any content you submit, post, or upload to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving the Service.

7.2 Our Content

All content on the Service, including but not limited to text, graphics, logos, questions, answers, and software, is the property of GamsatGenie or its content suppliers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

8. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems (bots, scrapers) to access the Service
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to create competing products or services

9. Limitation of Liability

To the maximum extent permitted by law, GamsatGenie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The Service will meet your specific requirements
• The results obtained from using the Service will be accurate or reliable

While we strive to provide accurate and helpful content, we do not guarantee that using our Service will result in passing the GAMSAT exam or achieving any specific score.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by cancelling your subscription and contacting us to delete your account. Upon termination, all data associated with your account may be deleted in accordance with our Privacy Policy.

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law
